Terms & Conditions

These Terms & Conditions apply to all orders placed with Cakes by Helena Brown. By placing an order, you agree to be bound by these Terms & Conditions.

1. Orders and Bookings

All cake orders are subject to availability and acceptance.

A booking is only confirmed once we have received the required deposit and provided written confirmation of your order.

It is the customer's responsibility to ensure all information provided, including event dates, addresses, dietary requirements, and design specifications, is accurate.

2. Deposits and Payments

A non-refundable deposit of 25% of the total order value is required to secure your booking date.

The remaining balance must be paid in full no later than 4 weeks before the collection or delivery date unless otherwise agreed in writing.

Failure to make payment by the specified due date may result in cancellation of the order without further notice.

3. Design and Alterations

We will endeavour to create your cake as closely as possible to any agreed design.

As all cakes are handcrafted, slight variations in colour, decoration, texture, and finish may occur and should be expected.

Reference photographs are used as inspiration only and exact replication cannot be guaranteed.

Any requested changes to the design, flavour, size, or delivery details must be made in writing and may incur additional charges.

Major design changes requested within 4 weeks of the event date may not be possible.

4. Allergens and Dietary Requirements

Customers must inform us of any allergies or dietary requirements when placing an order.

While we take reasonable precautions, our kitchen handles allergens including nuts, peanuts, dairy, eggs, gluten, soy, and other allergens.

Therefore, we cannot guarantee that any cake is entirely free from traces of allergens.

We accept no responsibility for allergic reactions where customers choose to consume products after being advised of potential cross-contamination risks.

5. Collection

Customers are responsible for collecting cakes at the agreed date and time.

Upon collection, responsibility for the cake passes immediately to the customer.

Customers are encouraged to inspect their cake before leaving the premises, as acceptance confirms satisfaction with the product.

We cannot be held responsible for damage occurring after collection.

6. Delivery

Delivery charges will be agreed at the time of booking.

We will make every reasonable effort to deliver cakes on time. However, delays caused by traffic, weather conditions, accidents, venue delays, or circumstances beyond our control cannot always be prevented.

Where delivery and setup are included, responsibility passes to the customer or venue representative once delivery and setup have been completed.

7. Storage and Consumption

Cakes should be stored according to any guidance provided.

We cannot accept responsibility for damage, deterioration, or reduced quality caused by incorrect storage, handling, transportation, or display after collection or delivery.

Products should be consumed within the timeframe advised at collection or delivery.

8. Wedding Cake Setup

Where wedding cake setup is included, we will assemble and position the cake at the agreed venue location.

Once the setup has been signed off by the customer, venue staff, or designated representative, responsibility for the cake transfers to the customer.

We cannot accept liability for any damage caused by venue staff, guests, or third parties after setup.

9. Refunds and Cancellations

Refunds and cancellations are governed by our Refund Policy, which forms part of these Terms & Conditions.

By placing an order, customers acknowledge that they have read and accepted the Refund Policy.

10. Intellectual Property

We retain ownership of all designs, photographs, logos, website content, and marketing material created by us.

Photographs of cakes may be used on our website, social media platforms, and marketing materials unless otherwise agreed.

11. Limitation of Liability

Our liability in connection with any order shall be limited to the value of the order placed.

We shall not be liable for indirect, consequential, or incidental losses arising from the use of our products or services.

12. Force Majeure

We shall not be liable for failure to perform our obligations where such failure arises from circumstances beyond our reasonable control, including but not limited to:

  • Severe weather

  • Natural disasters

  • Illness or injury

  • Government restrictions

  • Power outages

  • Supply chain disruptions

Where possible, we will make reasonable efforts to provide an alternative solution or refund.

13. Complaints

Any concerns regarding your order must be raised within 24 hours of collection or delivery.

We may request photographs and/or the return of any remaining product before investigating a complaint.

Complaints will be reviewed fairly and responded to as quickly as possible.

14. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
